All You Need To Know About The Australian Partner Visa

The Australian partner visa is designed for spouses and de facto partners of Australian citizens and permanent residents who wish to permanently or temporarily live in Australia. Most applicants often have a difficult time applying for this visa. Below are some things that you should know about the Australian partner visa. Hopefully, it will increase your knowledge of this visa and ease the application process.

Who Qualifies For This Visa?

This visa's primary eligibility criteria are that you should be a spouse or a de facto partner of an Australian citizen, permanent resident, or qualified New Zealand citizen. If you are married, you must be committed to each other and willing to live together permanently. Besides, your marriage must be recognised in Australia. Therefore, people married to their relatives or those in polygamous unions cannot apply for this visa. Visa applicants should be at least 18 years of age. Additionally, they should meet the health and character requirements set by the immigration department.

Who Can Be Your Sponsor?

As a rule, your sponsor should be your partner. The sponsor should have valid documents to prove that they are an Australian citizen, permanent resident, or eligible New Zealand resident. The sponsor should have a police certificate to prove that they are outstanding citizens. Besides, they should not have sponsored another person on a partner visa within the last five years.

Temporary Versus Permanent Visa

There are two classes of partner visas; subclass 820 (temporary visa) and subclass 801 (permanent visa). New applicants are required to apply for a temporary visa. This visa lasts for two years but can be renewed before the expiration date. If you wish to become a permanent Australian resident, apply for a permanent visa once you receive the temporary visa.

What Should You Expect After Application?

During application, you should upload your identification documents, describe your relationship status and provide evidence that you are in a genuine relationship with your sponsor. Once you file your application, the department may need you to clarify the information you provided. Besides, your case officer could request an interview. This is where an immigration lawyer comes in handy. The lawyer will review your application to ensure that you uploaded the correct documents. Additionally, the lawyer will handle feedback between you and the Home Affairs department. They will also be present during interviews.

You now have a comprehensive understanding of the Australian partner visa. When hiring an immigration lawyer, conduct some background research to authenticate their experience, licence and reputation.
